1. Acceptance of Terms

By accessing or using the GovData Labs website, API, or any related services (the "Services") operated by New Day Industries ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

2. Description of Services

GovData Labs provides a commercial REST API that delivers federal contractor intelligence data, including entity profiles, contract awards, verified contacts, AI-extracted capabilities, and related datasets. Data is derived from publicly available federal sources and enriched by our proprietary systems.

3. Accounts and API Keys

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the confidentiality of your API key.
  • You must not share, publish, or embed your API key in client-side code, public repositories, or any publicly accessible location.
  • You are responsible for all activity under your API key. Notify us immediately if you suspect unauthorized use.
  • We reserve the right to revoke API keys that violate these terms.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to circumvent rate limits, tier restrictions, or access controls
  • Create multiple free accounts to avoid usage limits
  • Resell, sublicense, or redistribute raw API data without written permission
  • Use the Services to build a product that directly competes with GovData Labs as a data API provider
  • Scrape, crawl, or systematically download data in excess of your tier's limits
  • Use the data to harass, stalk, or harm individuals
  • Misrepresent your identity or affiliation when using the Services

5. Pricing and Payment

  • Paid plans are billed monthly via Stripe. Prices are listed at govdatalabs.com/pricing.
  • You may upgrade, downgrade, or cancel your plan at any time. Changes take effect on the next billing cycle.
  • Refunds are not provided for partial months of service.
  • We reserve the right to change pricing with 30 days' notice.
  • The Sandbox (free) tier is provided as-is with no SLA or uptime guarantee.

6. Rate Limits and Fair Use

Each tier has defined rate limits (daily or monthly request caps and per-request result limits). Exceeding your limit will result in HTTP 429 responses until the limit resets. Systematic attempts to circumvent rate limits may result in account suspension.

7. Data Accuracy and Disclaimers

  • Data provided through the API is derived from public federal sources and may contain inaccuracies, delays, or omissions.
  • AI-enriched fields (capabilities, clearances, company summaries) are generated by automated systems and may not be fully accurate.
  • The Services are provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee the completeness, accuracy, or timeliness of any data.
  • You are responsible for verifying data accuracy for your specific use case, especially for compliance, legal, or financial decisions.

8. Intellectual Property

The raw federal data served through the API is public domain. However:

  • Our API design, documentation, website content, and branding are proprietary.
  • AI-enriched data, derived datasets, and our data processing methodologies are proprietary.
  • You may use API responses in your products but may not redistribute raw data feeds or bulk exports without a Data License agreement.

9. Limitation of Liability

To the maximum extent permitted by law, New Day Industries shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these terms, with or without notice. Upon termination, your API key will be revoked. You may terminate your account at any time by canceling your subscription and contacting us.

11. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or website notice at least 30 days before taking effect. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes will be resolved in the courts of the jurisdiction where New Day Industries is incorporated.
